“Twota” Terms of Service and End-User License Agreement (EULA)

Operated by: Twota Technologies Inc. Effective Date: September 8, 2026 Welcome to "Twota" ™, a social networking platform with a built-in dating feature designed to help users connect for dating, friendship, or both. By downloading, accessing, or using "Twota", you acknowledge and agree to be bound by the following Terms and Conditions ("Terms"). These Terms form a legally binding agreement between you and Twota Technologies Inc., a company incorporated in British Columbia, Canada ("Twota", "we", "us", or "our"). If you disagree with these Terms, you must not use "Twota". Introduction Twota Technologies Inc. operates the "Twota" app, available on the Apple App Store and Google Play Store. The app includes the following features: ◾"Explore": ▪"New": In the "New" tab, browse users filtered by sexuality, age, distance, and other preferences using our intelligent matching algorithm. You can like or dislike profiles — mutual likes result in a match. ▪"Wall": The "Wall" tab is available to users who have created a "Vibe". In this tab, users can explore vibes posted by other users, filtered by sexuality, age, distance, and additional preferences. Contact displayed on the wall is visible only to verified users. ◾"Bar": Connect in real time with online users who match your sexuality, age, and distance preferences. ◾"BlindDate": A weekly anonymous match every Friday, displaying only your name and a blurred photo. To initiate a chat with a BlindDate match, you must be a verified user. ◾"Messages": Enables users who have mutually matched to communicate through private conversations within the app. "Twota" is committed to fostering respectful, safe, secure, and meaningful interactions, and may adopt, modify, or enhance features at any time without prior notice. Acceptance of Terms By using "Twota", you confirm that: ▪You have read, understood, and accepted these Terms. ▪These Terms constitute a legally binding agreement. ▪Continued use after updates constitutes continued acceptance. We may revise these Terms at any time. Any changes will be communicated through the app, notification or via email. By continuing to use the app after changes are made, you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the app immediately. Arbitration Clause: By agreeing to these Terms, you waive any right to a jury trial or participation in class actions or class-wide arbitration. Arbitration will be on an individual basis only. Eligibility To use "Twota", you must: ▪Be at least 18 years old. ▪Be legally capable of entering into binding agreements. ▪Comply with all applicable local, provincial, federal, and international laws. ▪Provide truthful, accurate and up-to-date information in your profile and chats. ▪Not have been previously banned or removed from our services. ▪Not impersonate any person or entity, or misrepresent your affiliation. We reserve the right to verify your age and identity at any time. Any violation of these requirements may result in immediate suspension or termination of your account without notice or refund. User Accounts 4.1 Account Creation To use "Twota", you must create an account by providing honest, accurate and complete information, including your name, age, gender, location, and preferences. 4.2 Verification To keep our community safe, genuine, and authentic, and also to access certain features, all users are required to verify their profile within "23 days" of registration. Failure to complete verification within this timeframe may result in some restrictions. To apply for verification: ▪Make sure your profile is complete and up to date. ▪Every photo in your profile is of you, and each photo should be different. ▪Your face is clearly visible in every photo. ▪All photos are recent (taken in 2026 or 2025). ▪Submit a clear, well-lit selfie showing your face centered and unobstructed. ▪You may attempt verification up to "10 times". After 10 failed attempts, your account will be permanently invisible. This means your access to "Twota" will be limited. Your verification selfie is compared, manually and/or through automated image comparison, against your profile photos to confirm they depict the same person. We do not generate or store a persistent biometric identification template from this selfie, and it is not matched against any database outside "Twota". 🔔 Important Note: Uploading altered or misleading photos for verification may result in failed verification, restrictions, or permanent suspension. 🔔 Important Note: A "verified" badge indicates that the user's selfie has been manually reviewed and reasonably matches their profile photos. However, no verification process is entirely foolproof. Despite our efforts, some individuals may attempt to circumvent the system. Users are strongly encouraged to exercise caution and good judgment when engaging with others. "Twota" does not guarantee the accuracy of any user's identity, including those marked as verified. 4.3 Account Visibility, Suspension and Removal To protect the safety, authenticity, integrity, and trust of the "Twota" community, we reserve the right to make a user account invisible, suspend it, restrict its access, or permanently disable or remove it under the following circumstances: ▪Profiles That Are Not Authentic or Trustworthy A profile may be made invisible or restricted if it contains: ▷ Low-quality, watermarked, misleading, unrealistic, or inappropriate photos. ▷ Incomplete, misleading, or low-effort profile information. ▷ Personal contact information, such as phone numbers, email addresses, or other direct contact details. ▷ Any content that violates our Terms of Service, Community Guidelines, or other applicable policies. 🔔 Important Note: If a user creates a profile containing low-quality, watermarked, unrealistic, or inappropriate photos; incomplete or low-effort profile information; content that violates our Terms or Policies; or personal contact information, such as a phone number, within profile sections, the profile may be temporarily hidden. The profile may remain hidden until the user updates the relevant content and, where required, successfully completes the verification process. This measure is intended to help maintain a safe, authentic, and trustworthy community for all "Twota" users. ▪Unverified Accounts Beyond 23 Days: If a user creates a "Twota" account but does not successfully complete the required verification process within "23 days" of account creation, "Twota" may make the account invisible, restrict access to it, suspend it, or permanently disable or remove it. 🔔 Important Note: This requirement applies regardless of whether the user has submitted a verification request or has not yet applied for verification. Simply submitting a verification request does not satisfy the requirement; the verification process must be successfully completed. ▪Inactive Accounts Beyond 90 Days: If a user creates a "Twota" account but does not engage with or use the "Twota" application for more than "90 days", "Twota" may classify the account as an inactive account. In such circumstances, "Twota" may take appropriate action, including making the account invisible, restricting access, suspending, blocking, or permanently deleting the account, where permitted by applicable law and without prior notice. 4.4 Account Responsibility You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please report to us immediately any unauthorized access or use. 4.5 Account Pausing Paused accounts do not appear in Explore, but users can still use Bar, BlindDate, and message existing matches. 4.6 Match and Message Limits ▪Maximum active matches: 2 matches ▪Maximum messages per match: 14 messages ✅ Note: If a user exceeds 2 active matches, they will be unable to interact with new users or existing matches until they unmatch one or more to return within the permitted limit. 4.7 Account Deletion You may delete your account at any time by going to Profile > Account and selecting "Delete Account". If you signed up using an email address (not through the "Signed up with Google"), you will need to confirm your identity by entering your password. You will also be asked to answer a brief question about whether you found a partner through the app. Once confirmed, your account and all associated data will be permanently deleted. Code of Conduct You agree to: ▪Be honest and transparent in your profile and conversations. ▪Treat all users with respect and dignity. ▪Refrain from impersonation, scams, or hate speech. ▪Do not post or share private or sensitive information. ▪Do not engage in any activity involving minors, including child sexual abuse or exploitation (CSAE) ▪Refrain from ghosting or ignoring your active matches. Anti-Ghosting Policy ▪1st Offense: Friendly reminder ▪2nd Offense: 1-day suspension ▪3rd Offense: Permanent ban We reserve the right to enforce this policy at our discretion, based on user reports. By using "Twota", you agree to engage with your active matches respectfully and refrain from ghosting. Content 6.1 User-Generated Content You are solely responsible for any content you post, share, or transmit on "Twota" including text, images, voice recordings, and videos. To protect our users, "Twota" employs multiple safeguards and moderation mechanisms for user-generated content, including: ▪A filtering system (using AI and manual review) to detect and block objectionable material before it appears in public feeds. ▪An in-app reporting system allowing users to flag offensive content or behavior. Reports are reviewed promptly by our moderation team. ▪The ability to block and report abusive users directly from profiles or chats. ▪Published contact information (see "Contact Us" section) so users can easily reach our support team. 🔔 Important Note: "Twota" has zero tolerance for any form of objectionable, sexual, violent, threatening, or abusive content or behavior. This includes, but is not limited to, pornographic material, harassment, bullying, objectification of real people, hate speech, and any Chatroulette-style or "hot-or-not" experiences. Accounts found to engage in such conduct will be immediately removed without notice. If your app experience includes access to user-generated content from external web sources, such content is hidden by default and only displayed when explicitly enabled by the user through our website. All content remains subject to our Terms and moderation policies. 6.2 Profile Visibility All information, photos, and details that users provide to create their profiles — including but not limited to name, gender, age, height, approximate location, sexual orientation, preferences, and biography — are publicly visible to other users within the "Twota" app, in accordance with each user's privacy settings and applicable laws. Users are advised not to include sensitive personal or contact information in their profiles, as such information may be visible to other users. 6.3 Prohibited Content You must NOT upload or share content that is: ▪Illegal, misleading, or infringing upon the rights of others. ▪Sexually explicit, pornographic, or involving minors in any way, including any form of child sexual abuse or exploitation (CSAE). ▪Threatening, violent, abusive, or promoting hate speech. ▪Defamatory, discriminatory, or invasive of someone's privacy. ▪Offensive, deceptive, or intended to deceive or harm others. 6.4 Moderation We may use AI tools and manual review to moderate or remove content, and to suspend or terminate accounts that violate our policies. If you believe a moderation decision was made in error, you may contact us to appeal. 6.5 License to Content You retain ownership of your content but grant us a non-exclusive, royalty-free, worldwide license to use, modify, reproduce, and display it for purposes related to the app's operation, improvement, and promotion. 6.6 Copyright Complaints (DMCA Takedown Procedure) If you believe content on "Twota" infringes your copyright, please contact us at " [email protected] " with the following information: ▪A description of the copyrighted work you claim has been infringed. ▪A description of where the allegedly infringing content appears in the app. ▪Your full contact information (name, address, phone number, email). ▪A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law. ▪A statement, made under penalty of perjury, that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf. ▪Your physical or electronic signature. Twota Technologies Inc. also maintains, or intends to register, a designated DMCA agent with the U.S. Copyright Office, in addition to the contact above, to preserve safe-harbor protections available under U.S. law. Privacy Your use of "Twota" is subject to our Privacy Policy. By using the app, you consent to our collection, use, and disclosure of your personal information as described therein. Please read the "Privacy Policy" section carefully. Safety and Security 8.1 Reporting Users ▪All users can report their active matches directly within the chat. 8.2 Personal Safety Do not share any financial information or other sensitive personal data with other users. "Twota" is not responsible for any harm, loss, or misuse that may result from such disclosures. 8.3 Fraud and Scams We employ both automated systems and manual reviews to detect fraudulent activity. Users found in violation of our policies may be suspended or permanently removed. 8.4 Zero-Tolerance Policy "Twota" enforces a zero-tolerance policy against: ▪Underage users ▪Child sexual abuse or exploitation (CSAE) ▪Fake profiles or scams ▪Harassment, abuse, or discrimination ▪Any illegal or harmful activity 8.5 Child Safety and Protection Policy (CSAE) Twota Technologies Inc. maintains a strict zero-tolerance policy regarding child sexual abuse and exploitation (CSAE). The "Twota" app is intended only for adults aged 18 years or older. Any attempt by a minor to access or use the service is strictly prohibited. Users are strictly prohibited from: ▪Uploading, sharing, requesting, or promoting any content involving minors in a sexual context ▪Engaging in grooming, exploitation, or inappropriate communication with minors ▪Sharing or distributing child sexual abuse material (CSAM) ▪Attempting to create accounts for individuals under the age of 18 ▪Using the service in any way that could endanger a minor Any violation of this policy will result in immediate account suspension or permanent removal. 🔔 Important Note: Twota Technologies Inc. reserves the right to report suspected child sexual abuse, exploitation, or child sexual abuse material (CSAM) to appropriate law-enforcement authorities and child-protection organizations, in accordance with applicable laws and regulations. We fully comply with all applicable child safety laws, including but not limited to laws related to the prevention of child sexual exploitation and online abuse. Users may report any suspected child safety violation using the in-app reporting system or by contacting us directly. (iOS) Termination We reserve the right to suspend or terminate any account for violations of our policies or at our sole discretion. Termination will result in the loss of all access to the app and its features. Disclaimers ▪"Twota" is provided on an "as is" basis with no guarantees. ▪Matches and recommendations are not guaranteed. ▪Content or advice is not professional or legal advice. ▪No background checks are conducted on users. ▪We do not guarantee uninterrupted, completely secure, or error-free service. ▪"Twota" may utilize automated systems and artificial intelligence (AI) to assist with moderation and matchmaking. These systems are continuously reviewed and improved, but are not guaranteed to be flawless. Limitation of Liability To the fullest extent permitted by law, "Twota" disclaims all liability for: ▪Loss of profits, data, or other intangible losses. ▪User conduct or interactions, whether online or offline. ▪Any indirect, incidental, consequential, or punitive damages arising from the use of the app. Dispute Resolution and Governing Law ▪These Terms are governed by the laws of British Columbia, Canada. ▪Any disputes will be resolved through binding arbitration in Vancouver, in accordance with the rules of the Canadian Arbitration Association. ▪Class actions and class-wide arbitrations are not permitted. ▪You may opt out of arbitration by submitting written notice within 30 business days of accepting these Terms. ▪If you are a consumer residing in the European Union, you retain all mandatory rights under applicable EU consumer protection law ▪If you reside in the European Union, the United Kingdom, or another jurisdiction whose law grants mandatory consumer-protection rights that cannot be waived by contract — including the right to bring a claim before your local courts — the arbitration and class-action-waiver provisions above apply only to the extent permitted by that law, and you retain those mandatory rights notwithstanding anything else in this Section. Intellectual Property All content within the app — excluding certain fonts, icons and images — is the intellectual property of Twota Technologies Inc. Any reproduction, distribution, or reuse of this content without prior written consent is strictly prohibited. 13.1 Images/Icons Attribution Notice Some images/icons used in "Twota" are sourced from third-party libraries and are subject to their respective licenses. Full attribution and licensing details can be found at: Full Attribution and Licensing Details Third-Party Links "Twota" may contain links to third-party websites or services, which are provided solely for your convenience. We do not endorse and are not responsible for the content, privacy practices, or operations of any third-party websites or services. Accessing these links is at your own risk. Indemnification You agree to indemnify, defend, and hold harmless Twota Technologies Inc., along with its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses — including reasonable legal fees — arising out of or related to your use of the app or any violation of these Terms. Force Majeure We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet outages, power failures, labor disputes, acts of government, or other unforeseen events. No Waiver Failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce that provision or any other provision at a later time. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Changes to the Service We may modify or discontinue features without prior notice. We are not liable for service changes. Feedback and Suggestions Any feedback or suggestions submitted by you become our property. We may use them without compensation. Child Safety Standards Twota Technologies Inc., developer of the "Twota" app (published on Google Play Store as "Twota: Dating with Heart"), strictly prohibits any form of Child Sexual Abuse and Exploitation (CSAE) on its platform. (Android) / Twota Technologies Inc., developer of the "Twota" app (published on Apple App Store as "Twota: Dating with Heart"), strictly prohibits any form of Child Sexual Abuse and Exploitation (CSAE) on its platform. (iOS) 21.1 Zero-Tolerance Policy The "Twota" app does not allow any content, behavior, or interaction that involves, promotes, or facilitates the exploitation or abuse of minors. Prohibited activities include, but are not limited to: ▪Uploading, sharing, or distributing child sexual abuse material (CSAM) ▪Grooming or attempting to establish contact with a minor for sexual purposes ▪Sexualization of minors in any form ▪Sextortion involving minors ▪Trafficking or solicitation involving minors ▪Creating accounts for individuals under 18 years old ▪Any interaction that endangers a child 🔔 Important Note: Any violation will result in immediate account suspension or permanent removal. 21.2 Reporting, Enforcement, and In-App Reporting Mechanism Twota Technologies Inc. actively monitors reports and uses automated systems and manual moderation to detect harmful content. All users can block or report other users from the chat screen. Verified users can also block or report users anywhere in the "Twota" app where reporting buttons are available. Available report options include: ▪Just not interested ▪Fake Profile ▪Scam or Fraud ▪Abusive Behaviour ▪Hate Speech ▪Inappropriate Content ▪Child Safety Handling Reports: We use a reporting threshold system to identify accounts that may violate our policies. When a report threshold is reached, the account is flagged in the Reports Admin Panel for review by our moderation team. Each report is reviewed carefully. Depending on the severity of the violation, actions may include: ▪Warning the user ▪Temporary suspension ▪Permanent suspension (Blocked Account) ▪Permanent account removal Reports involving child safety are treated with the highest priority and are not subject to the standard threshold above — a single credible report can trigger immediate review. Child Safety Enforcement Any report involving child safety, minors, underage users, child sexual abuse, exploitation, or suspected CSAM is treated with the highest priority. When Twota Technologies Inc. obtains actual knowledge of child sexual abuse material (CSAM) or child exploitation, we will: ▪Remove the content immediately ▪Suspend or terminate the responsible account ▪Preserve evidence when required by law ▪Report the incident to appropriate law-enforcement authorities ▪Report to the National Center for Missing & Exploited Children (NCMEC) or the appropriate regional authority when required 🔔 Important Note: Twota Technologies Inc. reserves the right to take any action necessary to protect users, comply with child safety laws, and maintain a safe environment on the platform. (iOS) 21.4 Compliance With Child Safety Laws Twota Technologies Inc. complies with all applicable child safety laws and regulations, including laws related to the prevention of child sexual abuse, child exploitation, and online safety. Where required by law, Twota Technologies Inc. will report confirmed CSAM to the National Center for Missing & Exploited Children (NCMEC) or the appropriate regional authority. End-User License Agreement (EULA) 22.1 Relationship with Apple This Agreement is between you and Twota Technologies Inc., not Apple Inc. Apple Inc. is not responsible for the "Twota" app or any of its content. Your use of "Twota" must also comply with the Apple Media Services Terms and Conditions. Twota Technologies Inc., not Apple, is solely responsible for the Licensed Application and everything contained in it. 22.2 License Scope Twota Technologies Inc. grants you a limited, non-transferable license to install and use "Twota" on any Apple-branded product that you own or control and as permitted under the Usage Rules in the Apple Media Services Terms and Conditions. You may also access and use "Twota" through Family Sharing or volume-purchasing arrangements provided by Apple. 22.3 Maintenance and Support Twota Technologies Inc. alone is responsible for providing any maintenance or support services for "Twota", as required by these Terms or applicable law. Apple Inc. has no obligation whatsoever to furnish any maintenance or support services for "Twota". 22.4 Warranty Twota Technologies Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent they have not been disclaimed under these Terms. If "Twota" fails to conform to any applicable warranty, you may notify Apple Inc., and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple Inc. will have no other warranty obligation with respect to "Twota", and any other losses, liabilities, damages, costs, or expenses arising from a warranty failure are the sole responsibility of Twota Technologies Inc. 22.5 Product Claims Twota Technologies Inc., not Apple Inc., is responsible for addressing any claims made by you or a third party relating to your possession or use of "Twota". This includes, without limitation: (i) product-liability claims; (ii) claims that "Twota" fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar laws, including any use of HealthKit, HomeKit, or comparable frameworks. 22.6 Intellectual-Property Rights If a third party claims that "Twota" or your possession and use of it infringe that third party's intellectual-property rights, Twota Technologies Inc., not Apple Inc., is solely responsible for investigating, defending, settling, and resolving such a claim. 22.7 Legal Compliance By using "Twota", you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist-supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. 22.8 Developer Information ▪Developer Name: Twota Technologies Inc. ▪Registered Jurisdiction: British Columbia, Canada ▪Email: [email protected] ▪Website: www.twota.ca ▪Phone: (+1) 778-330-9682 If you have any questions, complaints, or claims regarding "Twota", please contact us using the information above. 22.9 Third-Party Terms When using "Twota", you must comply with all applicable third-party agreements. For example, if "Twota" allows communication over the internet or through your mobile network, you must ensure that such use does not violate your wireless-data-service agreement or any similar contract. 22.10 Third-Party Beneficiaries Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of these Terms, Apple Inc. will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary. 22.11 Prohibited Conduct and Zero-Tolerance Policy You acknowledge and agree that your use of "Twota" is subject to Twota Technologies Inc.'s strict zero-tolerance policy for objectionable, abusive, or unlawful content or behavior. You must not upload, transmit, or engage in any activity that includes or promotes sexual, violent, threatening, harassing, hateful, discriminatory, or otherwise offensive material. Twota Technologies Inc. reserves the right to suspend or terminate your account and to remove any content at its sole discretion if such conduct occurs. Twota Technologies Inc. will cooperate with law-enforcement authorities and Apple Inc. where required by applicable law.
